| | General terms of sale Article 1: Scope
These General Terms of Sale define the rights and obligations of the purchaser concerning the following products sold in the NoDiktat catalogue : - Clothes ;
- Screenprinting ;
- Posters ;
- Design objects ;
- Wallpaper ;
- Furnitures ;
- ....
Consequently, any purchase order placed with NoDiktat entails the buyer’s acceptance without reserve of these general terms of sale.
Article 2 : Prices
The prices of the products correspond to those in effect at the time of the order. They are indicated in Euros and do not include delivery charges.
In consequence, the delivery charges valid on the day of the order will be added to these prices.
NoDiktat reserves the right to modify its prices at any time.
However, NoDiktat warrants that products will be charged the prices indicated on the day of the order.
Article 3: Rebates and Promotional Offers
The rates which are proposed include all rebates and discounts that NoDiktat might offer.
Article 4: Discount
No discount will be granted in case of early payment.
Article 5: Payment
The customer will be charged the price indicated on the confirmation of order sent by NoDiktat. The payment is immediately due on the day the order is placed and can be made with a Credit Card. The data concerning his bank card is directly transmitted to the server of the Banque Populaire Côte d’Azur in SSL 128 bits secure mode. At no time does NoDiktat access or store this information.
Article 6: Retention of title
The delivered goods will remain NoDiktat’s property until all of the customer’s obligations have been met, particularly until full payment has been made.
Article 7: Delivery
Delivery at the address indicated by the buyer on the order form is undertaken by a shipping company.
The delivery time indicated when placing the order is an average deadline that will vary according to the destination, the shipping mode and the availability of the item.
In consequence, overrunning this deadline will not entail any order cancellations, any reductions in the price paid by the purchaser.
Transport risk is entirely undertaken by the shipping company.
If products are missing or found deteriorated during the shipping, the buyer must write down every necessary reservation on the order form on the day of the reception of these products.
These reservations must, as well, be confirmed within five days following the delivery on a letter sent by certified mail with acknowledgment of receipt.
Article 8 : Force Majeure
NoDiktat cannot be accused of breach of contract in the event of stock unavailability or in the case of an article being temporarily out of stock, in the event of ”force majeure”.
Article 9 : Litigations and court jurisdiction
The present general terms of sale are governed by the laws of France. Any disputes regarding the business relationship that exists between the client and NoDiktat will fall within the sole jurisdiction of the Antibes Commercial court.
