Our products’ prices are indicated in euros, all taxes included and apart from the shipping and handling fees.
In case of delivery to a country other than Metropolitan France, the orders’ recipient will be considered as the importer of the concerned products.
For all products sent outside of the European Union and for the French overseas departments and territories, the prices will be calculated with no taxes included.
All the orders, whatever their origins, are due in euros (or dollars ??) on the order’s date.
Nodiktat reserves the right to modify its prices at any time and without notice. The products will be charged on the rate’s bases in effect at the order’s date, provided their availability.
All prices are given unless typographical errors occured.
The products remain Nodiktat’s property until the billing is completed.

The buyer declares having read, understood and agreed to the present general selling conditions.
Therefore, he/she accepts the order, fully and without reserve.
The data recorded by Nodiktat stands as a proof of all the transactions made between Nodiktat and its customers.
Nodiktat will systematically confirm by email the order as well as its shipping.

Our products and prices’ offers are valid as long as they are visible on the website.
They are proposed in the limit of available stocks.
The availability of all the items within the same order cannot be guaranteed.
In case of product unavailability after the order, the buyer will be informed of the out of stock items by email or telephone in the shortest time.
The customer will be charged only after this verification and if the majority of the order’s items is available.
The buyer will have 48 working hours (except weekends and legal holidays) to cancel or exchange his/her order by contacting our customer service.
Beyond this 48 working hours period, and if the buyer makes no request, the order will be sent with available items. The missing items will sent later without additional fees.

The payment of purchased items can be made by credit card, check, or bank transfer.
Accepted credit cards are: Visa, Eurocard, Mastercard, American Express…
The credit card will be charged when order is submitted.
Payment by bank check is only possible if it is made in euros.
In all cases, the order will be sent as soon as the payment is received.
The bank check will be cashed when it is received.

Delivery is provided worldwide.
The offer is in total conformity with French legislation and it is the responsibility of foreign buyers to be in accordance with the importation law in effect in their state or country.
The items will be sent to the delivery address indicated by the buyer during the order process.
The participation for shipping fees is calculated all taxes included.
All orders are confirmed by email.
For shimpents outside of the European Union, potential charges (local VAT tax, custom or import taxes) will be charged to the recipient when receiving the package.

Indicated delivery time is an average data given as a guide.
It is due to the shipping and handling time treatment.
Shipping time differs according to the destination and does not include legal holidays nor weekends.
For most destinations, the average delivery time is evaluated between 4 and 12 days.
Delay cannot be a valid reason for the order’s cancellation and does not give any right to financial compensation.
In case of payment by check, the order will be processed at the check’s reception.
Consequently, the applicable delays in this case are those on check’s reception day and can therefore differ from those mentioned on the order’s day.
In case of strikes slowing or stopping products’ delivery, Nodiktat will do everything possible to inform customers on the package’s delivery state.
Any anomaly observed on the package’s appearance (damaged, already opened…) when received must imperatively be the object of reserves on delivery receipt for any ulterior complaint.

Complaints concerning the package’s state or content must be notified by certified mail with the receipt as soon as the package is received and no later than 72 hours to Nodiktat to be taken into consideration (article 105, Commercial Code).
Beyond this time, no complaint will be accepted and even less admitted as an opposition to the order’s payment.

According to Article L 121-16 of the Consumption Code, the buyer has a right of cancellation of 7 days starting on the order’s delivery date. He/she engages him/herself to inform the seller by email, during that time span, of all products’ returns that should not suit, without any justification.
We engage ourselves to refund or exchange flawed products or that should not correspond to order.
The request must be made within the 15 workdays following the delivery.
The products must be returned in received state with all items delivered (accessories, package…) and along with a copy of the purchasing bill.
However, we won’t take back:

Buyer can benefit from the legal warranty against latent defects (Article L211-1, Consumption Code).
Proposed products are conform to the French legislation in effect.

Nodiktat’s responsibility cannot be engaged in case of non-respect of the country’s law where products are delivered (for example, in case of product prohibition).
The buyer is in charge of verifying at local authorities import possibilities or use of products or services that he/she is about to order.
Nodiktat declines responsibility concerning the misused of ordered products.
Pictures or texts reproduced to illustrate presented products are not contractual.
Consequently, Nodiktat will not be responsible for any error in one of the picture or text.
The buyer will refer to each product’s description to know all exact characteristics; and in case of doubt he/she shall contact directly our company.
Nodiktat is not responsible for the non-execution of the concluded contract in case of stock shortage, unavailability of products, force majeure, disturbance, total or partial strike especially from postal services and/or communications or transportation means, flood, fire.
Nodiktat is not in charge of any indirect damages caused by business loss, profit loss, damages and charges.

These present conditions are submitted to French legislation and to Vienna Convention on goods’ international selling contracts.
The buyer’s nationality, delivery country, transaction currency or used language for order form or product description are not taken into account as an exemption to the application of French legislation to regulate customer/seller's relations.
The original language of the present agreement is French.
Any complaint concerning the interpretation or order’s execution will be examined with the greatest care and will be the object of an immediate amicable proposition.
In case of failure, the litigation will be directly handled by French court competence.

The VAT is applicable to concluded sales with residents of the European Union.
It is not applicable to companies other than French within the European Union and being holder of an intra-community VAT number.
These companies must address us an order by fax or mail with headed paper containing the company’s identification and its intra-community VAT number.
In case of online order, Nodiktat recommends the customer to choose bank transfer as payment modality to avoid being charged with the amount of French VAT. Indeed, our system of online payment by card does not allow us yet to handle automatically the case of non-French companies and being holder of a VAT number (e.g. Belgium). Sales from Metropolitan France to overseas departments and territories are calculated free of taxes.
Products are taxed on destination with the VAT rate in effect locally.
The VAT rate applied depends on the goods' delivery country.
It represents, in percentage of the good value, 19.6% for a delivery to Metropolitan France, Corsica and Monaco.

It will only be used for the order’s treatment, to reinforce and personalize communication (commercial letters, emailing, website improvement through user’s suggestions). Consequently, in accordance to IT and liberties’ law of January 6th 1978, the buyer has a right to access, change and oppose his/her personal data. The buyer can benefit from this right by sending us a request by email or mail indicating the email address, first name, last name, address and if possible customer reference.
